For Charities

Charities play a vital role in our society.  At Carbon Law Partners we don’t just know the relevant law inside out.  We understand Charities and what’s important to them.

Whether you work for a household name charity with substantial assets and income, or a small non-profit enterprise, we want to support you.  You can draw upon our Partners’ vast range of expertise from legacy dispute resolution to HR/employment support.

Why Carbon?  Charities love our ethos and flexible way of working.  Our Partners have the experience and knowledge to answer complex questions simply and quickly.  And because we don’t have large overheads like other firms, you get real value for money.

Legacy & Estate Disputes

Our team of expert contentious probate lawyers has worked with charities large and small, including all of the Top 20 charities by legacy income, helping to find solutions to the often complex issues that arise when a deceased donor’s Will or estate is subject to dispute.  Your charity may have regular legacy disputes, or you may be a small charity with a one-off but critical problem to resolve.  We’ll advise and support you every step of the way.

The law relating to wills and succession is a specialist area.   Our team has nationally recognised experts with the specialist legal knowledge needed to secure you the best outcome.  Our advice is always clear, strategic and simple to understand.

We deal with all types of legacy and estate disputes, including:

  • Challenges to the validity of the Will (by a beneficiary or potential beneficiary) on grounds of lack of mental capacity, want of knowledge and approval, undue influence, fraud.

  • Claims by family members, partners and dependants for reasonable financial provision under the Inheritance (Provision for Family and Dependants) Act 1975

  • Technical defects e.g. incorrect witnessing of a Will

  • Proprietary estoppel

  • Actions against negligent or fraudulent executors causing loss to an estate

  • Construction and rectification of Wills, and solicitors' negligent drafting of Wills

  • Lost or “missing” Wills

  • Claims to recover lifetime gifts procured by undue influence, transactions at an undervalue, or fraud by an attorney

  • Court of Protection – statutory Wills

We know that legacy donations are fundamental to supporting your charitable purposes.  But it’s not just about income.  Your charity’s good reputation in the eyes of the public and other stakeholders is just as important.  Which is why when we act for charities we do so in a sensitive way which protects and enhances that reputation.  You’ll come to regard us as a natural extension to your in-house team.

Only a small percentage of the cases we deal with end up in court.  We help you resolve disputes, whether it be from correspondence putting your case firmly but fairly to other parties’ lawyers, or by a round-table meeting or mediation.  We promote mediation whenever appropriate as an effective and cost-saving alternative to a court hearing.

We won’t drag you down a seemingly endless and expensive path.  Our focus is on getting you to the best outcome as efficiently as possible, saving you cost and time.  We’re good at finding creative solutions to difficult problems.

With access to our network of trusted lawyers working in other jurisdictions, we also provide advice and assistance on cases where the deceased held assets abroad.
